Introduction

Welcome to Evesong. These Terms of Service (“Terms”) govern your access to and use of the Evesong mobile application and website at evesong.io (together, the “Service”), operated by Evesong (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use Evesong.

Eligibility

You must be at least 18 years old to create an Evesong account. By using the Service, you represent that you are at least 18 years of age. Children under 13 may be added as household members by a parent or legal guardian, but may not create accounts or use the Service independently.

Your Account

You are responsible for maintaining the security of your account and for all activity that occurs under it. Evesong uses Google Sign-In for authentication — you are responsible for the security of your Google account. You agree to notify us immediately of any unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.

Households and Shared Data

Evesong is designed for household use. When you create or join a household, you understand that:

  • Events, tasks, lists, recipes, and budget data you create are visible to all members of your household.
  • Any household member can add, edit, or delete shared data.
  • The household creator can invite new members via invite code.
  • You are responsible for managing who has access to your household.

We are not responsible for any disputes between household members regarding shared data.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Interfere with or disrupt the Service or servers connected to it.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the AI features to generate harmful, abusive, or misleading content.
  • Upload or transmit viruses, malware, or other malicious code.
  • Use automated tools (bots, scrapers) to access the Service without our written consent.

We reserve the right to suspend or terminate your account if you violate these Terms.

Financial Data and Plaid

Evesong offers optional bank account connectivity through Plaid, Inc. By connecting your bank account, you:

  • Authorize Plaid to access your financial institution on your behalf.
  • Agree to Plaid’s End User Privacy Policy.
  • Understand that Evesong receives transaction data, recurring patterns, and account balances — but never your bank login credentials.
  • Acknowledge that financial data is used solely for budget tracking and spending insights within the app.

Evesong is not a financial advisor. Budget insights and AI-generated financial commentary are for informational purposes only and should not be considered financial advice.

AI-Powered Features

Evesong uses artificial intelligence (powered by Anthropic’s Claude) to provide features including daily briefings, natural-language input, recipe suggestions, and chat assistance. You acknowledge that:

  • AI-generated content may occasionally be inaccurate or incomplete.
  • AI responses are suggestions, not professional advice (financial, medical, legal, or otherwise).
  • We do not guarantee the accuracy, reliability, or completeness of AI-generated content.
  • Your interactions with AI features are processed by Anthropic in accordance with their Privacy Policy. Anthropic does not use your data to train their models.

Subscriptions and Payments

Evesong offers a free tier and an optional paid subscription (Evesong Pro). If you subscribe to Evesong Pro:

  • Payment is processed through Apple’s App Store. All billing is managed by Apple.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • You can manage or cancel your subscription in your Apple ID account settings.
  • Refunds are handled by Apple in accordance with their refund policies.

We reserve the right to change subscription pricing with reasonable notice. Price changes will not affect your current billing period.

Intellectual Property

The Service, including its design, code, branding, and content, is owned by Evesong and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission. Your content (events, tasks, lists, etc.) remains yours — you grant us a limited license to store, display, and process it solely to provide the Service.

Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of Liability

To the maximum extent permitted by law, Evesong shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Evesong and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the Service or violation of these Terms.

Termination

You may delete your account at any time. We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service. Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account deletion, except where required by law to retain it.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Massachusetts, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Massachusetts.
